This Privacy & Cookie Policy (“Policy”) describes how Blue Moose Designs (“we”, “our”, “us”) collects, uses, and protects your personal information when you visit our website or use our services (the “Services”), including through the DecoNetwork platform.

1. Information We Collect

  • Account and Contact Data: name, company, email, phone, and billing/shipping address.
  • Payment Information: processed securely by our payment providers; we do not store full card numbers.
  • Design Uploads and Order Content: images, logos, or text you upload for printing or customization.
  • Technical Data: IP address, browser type, operating system, referral URL, device ID, and site usage analytics.
  • Communications: messages sent to us through email, chat, or support tickets.

2. How We Use Your Information

  • To process and fulfill your orders.
  • To communicate regarding orders, support, and marketing (with consent where required).
  • To improve our website, products, and user experience.
  • To comply with legal obligations, prevent fraud, and enforce our Terms of Service.
  • To personalize offers and display relevant content or promotions.

3. Legal Bases for Processing (EU/EEA/UK Residents)

Where the EU General Data Protection Regulation (GDPR) or UK GDPR applies, we process your data under one or more of the following lawful bases:

  • Performance of a contract (to process your order or manage your account).
  • Compliance with legal obligations (e.g., tax and accounting laws).

  • Order and invoice records are retained for a minimum of seven (7) years to comply with tax and accounting laws.
  • Design upload proof records and copyright certifications are also stored for seven (7) years for legal defense and verification.
  • Marketing contact data is retained until you unsubscribe or request deletion.
  • We regularly review and securely delete or anonymize data that is no longer needed.

5. Cookies and Tracking Technologies

Cookies are small data files placed on your device to improve functionality and performance. We use both first- and third-party cookies as described below.

5.1 Types of Cookies Used

c_rt_ppr (first-party) Supports DecoNetwork session affinity across servers.

Google Analytics (_ga, _gid, etc.) Measures site usage and performance metrics.
DoubleClick / Google Ads Displays relevant advertising and remarketing.

5.2 Managing Cookies

You can control cookies through your browser settings or use the on-site cookie banner to adjust preferences. Disabling cookies may affect certain features (such as login persistence or cart contents).

6. Data Sharing and Disclosure

  • We share data with payment processors, shipping carriers, DecoNetwork, and trusted service providers only as necessary to perform our Services.
  • These partners are contractually bound to confidentiality and data protection obligations.
  • We may disclose data when required by law, to enforce policies, or to protect rights, property, or safety.
  • We do not sell personal data.

7. International Transfers

Your data may be transferred to and processed in the United States. We implement safeguards recognized under GDPR, including Standard Contractual Clauses, to ensure adequate protection.

8. Data Subject Rights (EU/EEA/UK)

If you are located in the EU/EEA or UK, you have the following rights:

  • Access to your personal data.
  • Correction of inaccurate or incomplete data.
  • Erasure (“right to be forgotten”) where no longer necessary or consent is withdrawn.
  • Restriction of processing in certain circumstances.
  • Data portability in machine-readable form.
  • Objection to processing for legitimate interests or direct marketing.
  • The right to withdraw consent at any time (where processing is based on consent).

To exercise these rights, contact Customer Support. We will respond within 30 days or the timeframe required by law.

9. Design Uploads and Intellectual Property

When you upload artwork, you must have full rights to reproduce and use it. By submitting designs, you certify ownership and grant Blue Moose Designs a limited license to reproduce them solely to fulfill your order. We store upload records for seven years for verification and legal defense. Unlawful uploads may result in account termination and referral to rights holders or authorities.

10. Security

  • All transmissions are encrypted via SSL/TLS.
  • Data is stored on secure servers with limited access controls.
  • We employ regular malware scanning, firewalls, and intrusion monitoring.
  • Despite safeguards, no online system is fully secure; you use the Services at your own risk.

11. Children’s Privacy (COPPA)

Our Services are not directed to children under 13. We do not knowingly collect data from children. If we become aware that a child has provided personal information, we will delete it promptly.

12. California Privacy Rights (CCPA)

California residents have the right to request information about data collected, request deletion, and opt out of sale (we do not sell data). To exercise rights under the CCPA, email sales@akbluemoose.com or call (907) 929-2583.

13. Email Marketing and CAN-SPAM Compliance

  • We collect email addresses to send order updates and marketing messages (with consent where required).
  • Emails will always include an unsubscribe link.
  • We do not use false headers or misleading subjects.
  • Requests to unsubscribe are processed promptly.

14. Data Breach Notification

If a data breach occurs that may affect your personal information, we will notify you by email and/or site notice within seven (7) business days and comply with all regulatory reporting obligations.

15. Changes to This Policy

We may update this Policy periodically. The revised version will be posted with a new effective date. Continued use of our Services after posting constitutes acceptance of the changes.
